In this episode, we discuss the growing problem of overregulation and how norm engineering and AI can be used to solve it.

Here are some thoughts from Vincent van Dijk, Senior Advisor on Norm engineering and rule-based solutions. Beyond his advisory role in the public sector in The Netherlands, Vincent partners with Be Informed to advance norm engineering practices on a global scale. 

Dealing with legal language is challenging, as rules cannot be directly articulated like everyday speech, hindering effective analysis. Norm engineering translates legal texts into explicit specifications or even executable models. It identifies decisions, norms, and evaluation grounds, turning legal grammar into tangible knowledge models, often AI-powered, to capture facts with clarity. This process involves encapsulating shared understandings and details without explicit statements.

Norm engineering represents a paradigm shift. It converts rules into data, facilitating robust analysis and querying capabilities. But it can be further powered with a different way of working of law makers and those implementing legal rules, where the gap in their current way of working needs to be bridged.

Some statistics from the articles on the topic: in the US, federal regulations now exceed 180,000 pages, up from 20,000 in the early 1960s; in the past five years the European Parliament has enacted more than twice as many laws as America; red tape costs the French economy close to 4% of GDP every year. A food consignment arrived in Israel and was found to be damaged due to a lack of refrigeration. The importer uses the foreign forwarder who transported from abroad to Israel. Will the court uphold the claim or will it decide that the claim should be adjudicated outside Israel? This will be discussed in this review in light of the court's recent decision.
