The topic of penalties has been a long-running one in the EU, and the proposed EU Reform package again refers to the desirability of harmonising penalties for customs infringements. But what do we mean by 'penalties'? UCC Art. 42 - Each Member State shall provide for penalties for failure to comply with the customs legislation. Such penalties shall be effective, proportionate and dissuasive.
There is no harmonisation of penalties in the EU. Nevertheless, there are general principles that can be tested at the EU level.
