Who doesn’t enjoy a bit of online shopping? Yet e-commerce poses many challenges not only in the EU but worldwide. The rise of companies like Shein and Temu, offering inexpensive products or that often fail to meet EU product standards and safety regulations and the staggering speed with which the number of e-commerce imports increases, has made e-commerce reform a highly debated topic. How should the EU address safety concerns? How does e-commerce impact the level playing field for EU companies? What would the removal of de minimis mean in practice?

Changes to e-commerce legislation in Türkiye

The new Decision published on August 6 in Türkiye states that the de minimis of EUR 150 applied to non-commercial goods shipped from abroad to an individual in Türkiye through mail or fast cargo … transport, will be lowered to EUR 30. According to the Decision, a fixed rate of duty will be collected at the rate of 30% of the value of goods if they come directly from EU countries and 60% if they come from other countries. This will apply to all goods coming to a natural person through mail or fast cargo transport below EUR 30 as well as medicines below EUR 1500.

In view of the largely failed centralisation (and thus … standardisation) of customs activities and – apart from ICS2 – IT systems, as well as a lack of harmonisation of customs sanctions, the proposals for an EU Customs Data Hub, an EU Customs Authority, the shift to the (deemed) importer as the person responsible for duties and all compliance aspects, as well as a partial harmonisation of customs sanctions are bold steps with regard to which the business community suffering from unequal treatment within the EU Customs Union and Single Market can only wish the EU Commission success in the Council and the Parliament.
